{Session Agreement}

Please complete the form below to reserve your session. Both this form and your session retainer fee* are required to guarantee your reservation. Read the form carefully before completing, and be sure to print a copy for your records, as this will serve as your official session contract. Terms and Conditions

1. It is understood that Lily Photography by Elizabeth is the exclusive official photographer retained to perform the photographic services requested on this Contract.

2. Lily Photography by Elizabeth may substitute another photographer to take the photographs in the event of Studio/Photographer’s illness or of scheduling conflicts.
In the event of such substitution, Studio/Photographer warrants that the photographer taking the photographs shall be a competent professional.

Multiple Session packages: including Milestones and Combination Session options, will be included in this single agreement. The terms and policies outlined in this document will apply to all sessions within the package. For clients purchasing the Milestones Session package, all sessions must be held within one 12 month period, beginning on the date of the first session. Any sessions not completed within this 12 month period will be forfeited.

4. Lily Photography by Elizabeth reserves and retains all rights and copyrights to use images created under this contract.

Model Release: Lily Photography by Elizabeth, studio reserves the right to use images created under this contract for advertising, display, publication or other purposes. The client signing this contract warrants that he/she has actual authority to agree to the use of the likeness of all persons included in the portrait in this manner and shall indemnify and defend the Studio/Photographer in the event of litigation arising out of such use. Negatives, digital files, and previews remain the exclusive property of Lily Photography by Elizabeth.

5. Upon signature, Lily Photography by Elizabeth shall reserve the time and date agreed upon. Unless the Studio is able to fully replace the cancelled reservation, all sitting fees and retainer deposits are non-refundable, even if the portrait is rescheduled or cancelled for any reason other than inclement weather.

6. If, in the opinion of photographer, inclement weather or other adverse conditions prevent the creation of a portrait meeting the artistic standards Lily Photography by Elizabeth,
the photographer may elect to use an alternative location or reschedule the portrait.

7. If Lily Photography by Elizabeth cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to photographer’s illness or emergency, then the photographer shall return any deposit or sitting fee to the client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event that Lily Photography by Elizabeth fails to perform for any other reason, Lily Photography by Elizabeth shall not be liable for any amount in excess of the retail value of the Client’s order.

8. Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of the dyes, and Client releases the Photographer from any liability for any claims whatsoever based upon fading or discoloration due to such inherent qualities.

9. Waiver of liability: client expressly releases the photographer, her employees and agents from all claims, damages, and liabilities that may result from accidents or incidents that occur during the portrait session. This waiver of liability includes waiver of any claim that may be a result of negligence.

10. The charges in the Contract are based on the Lily Photography by Elizabeth’s Standard Price List. Images will be kept on file for 12 months from the date of creation for additional reprints at a later date. The price list is adjusted periodically and future orders, shall be charged at the prices in effect at the time when the order is placed. No part of any order, including previews, will be delivered until the balance is paid in full. Sales Tax will be applied to all orders.

Session previews will be available within approximately three weeks of each session date. Online proof gallery will be available for 30 days. Portrait order must be placed within that period. There will be a fee of $10 per week to republish online gallery after 30 days, or to extend it past the expiration date.

11. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without Lily Photography by Elizabeth’s explicit permission, and violators of this Federal Law shall be subjected to its civil and criminal penalties. Likewise, clients cannot authorize any reproductions of the images, whether it is for commercial or personal use. That is to say, clients are not allowed to scan, print or send images through the internet or use images for photographic competition or display. Clients are also not authorized to save images from web preview gallery for any purpose. Clients are in no way authorized to allow any third party to scan, copy, or otherwise reproduce these images. *Clients may only post images online, that are Watermarked with Lily Photography By Elizabeth’s Logo. It is Illegal and an Infringement of Copyright Laws to post High-Resolution Images online.*

**All digital images include a personal print release, assigned to the client.*

**Images purchased may not be altered or edited, in any shape or form.**

12. This Contract incorporates the entire understanding of the parties.

A *Session Retainer Fee of $50.00 is required, for reservation. This fee goes towards the Price of your Session, but is non-refundable, in cancellation of your Session.
